On Oct. 8, 2009, NJDEP advised SMC that because the NRC accepted the current DP as meeting the timeliness provisions in 10 CFR 40.42, the Department has determined that SMC will remain in compliance if a revised DP is submitted by Jan. 31, 2010. The NRC Staff has submitted its Fifteenth Status Report to the ASLB and parties in the Shieldalloy DP proceeding. In this report, the Staff advises the Board that on September 23, 2009, the NRC and the State of New Jersey finalized an agreement pursuant to Section 274 of the Atomic Energy Act of 1954 and that regulatory authority over Shieldalloy's Newfield site was transferred to New Jersey as of September 30, 2009. For that reason, "the Staff has discontinued its review of Shieldalloy’s DP and forwarded files associated with its review to New Jersey. Accordingly, the Staff will not be issuing either a safety evaluation report or environmental impact statement with respect to Shieldalloy’s DP." The State of New Jersey and the United States Nuclear Regulatory Commission (NRC) have entered into an Agreement for the State to regulate source, certain special nuclear, and byproduct material, which Agreement is effective Sept. 30, 2009. Accordingly, the new rules and amendments to N.J.A.C. 7:28, Radiation Protection Programs, that were adopted Sept. 15, 2008, are operative as of September 30, 2009. Under the rules, the Department of Environmental Protection will regulate source, certain special nuclear and byproduct material, in accordance with the State's Agreement with the NRC.
